Terms of Use
Thank you for using Orange Line Media's website. By accessing the Orange Line Media website ("Site") you agree and acknowledge to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not access the Site. Orange Line Media reserves the right to change these Terms at any time. We recommend that you periodically check this Site for changes.
1. Usage License
Orange Line Media grants you a limited license to access the Site in accordance with these Terms and the instructions and guidelines posted on the Site. Orange Line Media reserves the rights to terminate your license to use the Site at any time and for any reason.
2. Submission of Content for Review
Any items you submit for review must be your own work. We have checks in place to detect duplicate content. All items submitted to us remain your property and we will only use them for review purposes unless you explicitly agree otherwise via written agreement. Please maintain copies of any files you submit to us. We will periodically purge unused files from our systems. Please do not submit any pornographic or questionable content. Doing so will result in your account being deleted. We are under no obligation to purchase any of the items you upload for review. You are under no obligation to sell them to us. Any purchases/exchanges of money will be governed by the Stock Photographer's Agreement which is available for your review upon request.
3. Grant of Rights
You will retain copyright ownership of all content you submit to the site for review unless we explicitly agree to do otherwise in writing. Content purchase requires both parties (you and us) to sign our Stock Photographer's Agreement. This agreement specifically addresses terms associated with content purchasing. Any content we do not purchase and pay for will be deleted from our servers.
4. No Warranty and Limitation of Liability
ORANGE LINE MEDIA PROVIDES THE SITE "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. ORANGE LINE MEDIA SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEGRATION, INTEROPERABILITY OR QUIET ENJOYMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. You understand and agree that you use the Site at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. UNDER NO CIRCUMSTANCES SHALL ORANGE LINE MEDIA BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, OR ANY OTHER DAMAGES WHATSOEVER (HOWEVER ARISING, INCLUDING BY NEGLIGENCE), INCLUDING WITHOUT LIMITATION, DAMAGES RELATED TO USE, MISUSE, RELIANCE ON, INABILITY TO USE AND INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE, DAMAGES INCURRED THROUGH ANY LINKS PROVIDED ON THE SITE AND THE NONPERFORMANCE THEREOF AND DAMAGES RESULTING FROM LOSS OF USE, SALES, DATA, GOODWILL OR PROFITS, WHETHER OR NOT ORANGE LINE MEDIA HAS BEEN ADVISED OF SUCH POSSIBILITY. YOUR ONLY RIGHT WITH RESPECT TO ANY DISSATISFACTION WITH THIS SITE OR WITH ORANGE LINE MEDIA SHALL BE TO TERMINATE USE OF THIS SITE. Some states do not allow the exclusion of liability for incidental or consequential damages, so the above exclusions may not apply to you.
5. Other
Orange Line Media and you are independent entities, and nothing in the Terms, or via use of the Site, will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between Orange Line Media and you. If we choose to purchase any images, we would execute a Stock Photographer Agreement which contains all the terms relevant to that transaction.
